Terms of Service

1. Definitions

"Platform" means the NTGlobalAcademy website and services operated by NTGlobal Technologies.

"User" means any person who accesses or uses the Platform, including Students and Tutors.

"Tutor" means a registered educator who publishes course content on the Platform.

"Student" means a registered user who enrolls in courses.

"Course Content" means all videos, documents, notes, quizzes, and materials uploaded by Tutors.

2. Eligibility

• You must be at least 18 years old to register as a Tutor.
• Students must be at least 13 years old. Users under 18 require parental consent.
• You must provide accurate registration information. False information may result in immediate account termination.
• Accounts are personal and non-transferable.

3. Tutor Obligations

• Tutors must complete identity verification (KYC) before publishing courses.
• Tutors warrant that all Course Content is original, lawfully obtained, and does not infringe any third-party intellectual property rights.
• Tutors must not publish content that is false, misleading, defamatory, obscene, or harmful.
• Tutors are solely responsible for the accuracy and quality of their Course Content.
• Course Content that constitutes professional medical, legal, or financial advice must include appropriate disclaimers.
• NTGlobalAcademy reserves the right to remove or suspend any Course Content or Tutor account for policy violations without prior notice.

4. Student Obligations

• Students may access enrolled course content for personal, non-commercial educational use only.
• Downloading, reproducing, reselling, or distributing course materials is strictly prohibited.
• Students must not share login credentials or grant access to enrolled courses to third parties.
• Ratings and reports submitted by students must be honest and in good faith. Abuse of the rating or reporting system may result in account suspension.

5. Payments and Subscriptions

• Tutor subscriptions are billed in advance and are non-refundable once a subscription period has commenced.
• Course purchase payments are processed via M-Pesa or Stripe. By completing payment, you authorise NTGlobalAcademy to charge the stated amount.
• Revenue earned by Tutors is held in a platform wallet and is subject to the Refund Policy before withdrawal.
• NTGlobalAcademy retains a platform commission of 20% on all course sales.
• Pricing is displayed in Kenyan Shillings (KES) unless otherwise stated.

6. Platform Conduct

Users must not:

• Attempt to hack, scrape, or reverse-engineer the Platform.
• Introduce malware, viruses, or any harmful code.
• Engage in fraud, identity theft, or impersonation.
• Use the Platform for any unlawful purpose under Kenyan or international law.
• Harass, threaten, or discriminate against other users.

7. Certificates

Certificates of completion are issued by NTGlobalAcademy and are verifiable on the Platform. They do not constitute academic credentials, professional qualifications, or accredited certifications unless explicitly stated.

8. Limitation of Liability

To the maximum extent permitted by law:

• NTGlobalAcademy is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
• NTGlobalAcademy's total liability in any dispute shall not exceed the amount paid by the User in the preceding 3 months.
• NTGlobalAcademy does not guarantee uninterrupted or error-free access to the Platform.

9. Account Suspension and Termination

NTGlobalAcademy may suspend or permanently terminate your account without notice if you breach these Terms, engage in fraudulent activity, or if your account poses a legal, reputational, or security risk to the Platform or its users. Upon termination, your access to enrolled courses and wallet balances will be subject to review on a case-by-case basis.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising from or related to these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to mediation under the Nairobi Centre for International Arbitration (NCIA) rules, failing which to the courts of Kenya.

11. Amendments

NTGlobalAcademy reserves the right to amend these Terms at any time. Material changes will be communicated via email or an in-platform notice at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
